Oklahoma lets an honest debtor choose which creditor eats first. That single rule colors every other provision in the workout, because preference without fraud is lawful and the sections that follow assume it.

Seven provisions of Oklahoma law shape the restructuring, each one read in full from official chapter text. They begin with the payment already made and end with the receiver who might collect the rest.

The Lawful Preference

Before the workout begins, before counsel sorts the payables, the owner pays someone. Title 24, Section 11 provides that an indebted person may in good faith prefer one or more creditors by payment, mortgage, or transfer of real or personal property, valid in the hands of a good faith mortgagee subject to the recording laws, as the preference section states. The rule is, in plain terms, a permission rather than a strategy, and it informs which payments made before the workout, and which grants of security, are defensible, and which invite attack as fraudulent transfers (good faith is a showing, not a slogan).

The preference, which counsel for unpaid creditors will call a fraudulent transfer, stands where good faith is shown. A payment with records behind it survives scrutiny that a panicked payment cannot, and the records should start now.

Collateral Law Without Regard to Form

Article 9 of the Commercial Code applies to transactions creating security interests in personal property or fixtures regardless of form, plus agricultural liens, sales of accounts, chattel paper, payment intangibles, promissory notes, and consignments. The scope section makes the point unavoidable: calling an advance a purchase of receivables does not remove it from Article 9 where its economic substance is a secured loan, and perfection and priority outcomes change with it.

The contract disavows any secured transaction. Economic substance decides the question anyway. And purchase language has never perfected anything. The inquiry covers the form, the substance, and the perfection the funder bothered to obtain. Independent counsel ensures the characterization question precedes payment. Whether the legislature meant to catch every receivables contract or only the abusive ones is a question the section leaves open.

The Six Percent Baseline

The legal rate is six percent absent a contract term, while parties may agree in writing to any rate authorized by law now or later enacted. The interest section thus sets the baseline for the whole rate fight: the question is which authorizing statute, if any, permits the contracted rate, and a recharacterized advance must locate one or face the default rule.

The cited section states the baseline and nothing about the penalty. The baseline is six percent.

Earnings and Undue Hardship

After execution, attachment, or garnishment issues, a debtor may apply for a hearing to exempt earnings from personal services to the extent needed to avoid undue hardship in maintaining a supported family or dependents, with child support and similar orders excepted. The earnings shield gives individual guarantors a procedural defense for necessary income even after a creditor reaches the garnishment stage, though what counts as undue hardship is left to the hearing.

A conversation with the creditor about wages, even casually, should wait until the hearing right is understood. Resist the urge to treat the garnishment as the final word.

The Homestead and the Household

Every state resident reserves from attachment, execution, and other forced sale for debts the home used as principal residence, a qualifying manufactured home, household and kitchen furniture, and the other personal property categories the section schedules. The general exemption section defines the asset pool a judgment creditor cannot reach: the principal residence, the qualifying manufactured home, and the household goods the section schedules.

Claims against the residence fail where the exemption holds, and the manufactured home provision deserves a second reading from owners who assumed only houses built on site count. Rural routes and rented lots hold more protected housing than collection letters admit, and the furniture and goods provisions protect the contents room by room. The exemption defines the negotiation before the negotiation starts, and it anchors realistic settlement floors in property no court will sell.

Most owners assume the home is at risk first. That fear is common, and the statute does answer it.

Deceptive Practices

Practices committed in the course of business stand judged against enumerated categories, including knowing misrepresentations of make, source, sponsorship, affiliation, and characteristics of the subject of a consumer transaction, with violations deemed serious offenses. The unlawful practices section gives deceptive funder marketing and collection misrepresentations a set of per se categories to be tested against. Funders that misdescribe their product understand the description. They count on no one reading the statute beside the brochure.

Misdescription is extremely common in solicitation and extremely costly in collection. The categories repay memorization.

Receivership

Supreme Court justices and district judges may appoint receivers in vendor fraud and creditor property actions, mortgage foreclosures, after judgment to carry it into effect or aid execution, and for dissolved or insolvent entities, among other cases. The receivership section hands a creditor seeking to displace management or capture rents and proceeds a defined path, which restructuring plans must anticipate. Rarely does a creditor file this motion without groundwork.

Simply identify the forum risk before the creditor does. Relief the owner seeks, or fails to seek, in the first days after default decides who controls the motion. There is an eerie speed to receivership once ordered.

The Code does not forgive the debt. It rations the remedies, and the question underneath all seven sections is who eats first, and under which statute. Delancey Street, a debt settlement company that coordinates with independently licensed counsel for legal work, assesses and pursues the defenses described here alongside the settlement negotiation beginning with a free confidential initial review, and the objective is to ensure no payment exceeds what the exemptions leave reachable.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
