Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
Oregon answers an overpriced small advance with forfeiture of all interest. The borrower who proves the loan behind the purchase repays principal alone, and the funder pricing above the cap finances its own penalty.
Seven provisions of Oregon law do the surrounding work, each one read in full from official chapter text. They run from the rate cap through possession, deception, exemptions, registration, and garnishment to the receivership code.
Nine percent is the default legal rate for moneys due, moneys retained for another’s use, and judgments, with contract rates above nine percent preserved in judgments on those contracts. Business, agricultural, and other loans of $50,000 or less face a harder ceiling: the greater of twelve percent or five points over the district discount rate, on pain of forfeiting all interest so that the borrower repays principal only. The interest section states the rule without apology (the discount rate on any given date is a question for the central bank release, not the contract).
Small advances priced above the cap are not aggressive. They are vulnerable. A funder prices above the cap in order to test whether the borrower knows the forfeiture rule, and recharacterization turns the test around.
After default a secured party may take possession of collateral, render equipment unusable without removal, and dispose of it on the debtor’s premises, proceeding judicially or otherwise only without breach of the peace, with assembly rights as agreed or after default. The possession after default section both arms a perfected lender and limits one: possession without judicial process that breaches the peace is unlawful, and every remedy in the section presupposes a valid and enforceable interest.
The agents arrive before dawn in these stories. The statute cares about the manner, not the hour. But every remedy presupposes a valid interest and a default under an enforceable agreement. Counsel should test the default and contest the possession before conceding anything. Clerks in these cases ask for the security agreement first and the repossession report second.
Passing off, confusion as to source or affiliation, false representations of characteristics or credit availability, and deceptive price or prize claims stand catalogued as unlawful practices committed in the course of business, vocation, or occupation. The unlawful practices section gives misleading solicitations, undisclosed stacking consent terms, and deceptive collection representations a set of categories to fall into, with public and private enforcement behind them.
Nobody reads the solicitation the way the statute reads it. A promise made on the telephone, even briefly, should be measured against the written terms. Which category a given solicitation fits is less obvious than the list suggests.
All of a judgment debtor’s property is bound for execution except as exempted, and the exemption chapter then removes books, apparel and personal items, trade tools, a vehicle, domestic animals, household goods and family provisions, and further scheduled interests within stated caps, as amended through 2024 Senate Bill 1595. The exemption section bounds what a judgment against the owner can seize: books, apparel, trade tools, a vehicle, domestic animals, and the household goods a family runs on.
The exemption list is the inventory of what survival requires.
The list fixes the floor before talks begin.
What the list protects is what settlement cannot spend. Most owners first see this list after a seizure. That timing is common.
No person may operate as a collection agency in Oregon without registering with the Department of Consumer and Business Services and maintaining that registration. The registration section is one sentence of prohibition with a registry behind it. Third party collectors working advance or loan paper should be checked against that registry, since unregistered collection activity is independently actionable. There are exceptions, though in practice they tend to confirm the rule.
Resist the urge to pay the unregistered voice. The registry is public.
A writ of garnishment delivered to a garnishee reaches all of the debtor’s personal property in the garnishee’s possession, custody, or control, expressly including wages, monetary obligations due or to become due, safe deposit contents, stocks, and bailment or lease property, limited to the debtor’s own interest. The garnishment scope section defines the endgame collection surface for a guarantor’s accounts and income streams: safe deposit contents, stocks, and the other intimate details of a financial life. The list is long.
What the garnishee holds, or claims to hold, for the debtor sets the boundary. What it keeps depends on the exemptions.
Courts may appoint receivers before judgment where property is endangered, after judgment to effectuate or preserve it, for attached or abandoned property, for dissolved or insolvent entities, and whenever reasonably necessary to secure justice, considering but not bound by contractual receiver clauses. The appointment section opens the forum, and the powers section fills it: operating the business, incurring debt, asserting claims including fraudulent transfer claims, assuming executory contracts, and distributing estate property. Months into a dispute, when the accounts are thin, either side may invoke this parallel forum.
Seldom does a creditor seek this forum without preparation. Simply ask which side benefits from court supervision before endorsing it. A receivership is extremely orderly and extremely expensive.
Forfeiture, exemption, and supervision are the three walls of the Oregon workout, and settlement happens inside them. Delancey Street, a debt settlement company that coordinates with independently licensed counsel for legal work, documents and pursues the defenses described here alongside the settlement negotiation beginning with a free confidential initial review, and the objective is to ensure no statement is made without counsel present.
Most funders accept 30–60% as a full settlement — with proper leverage.
