Seven Wisconsin authorities decide a restructuring before the first collector calls.

The seven sections below move from the collateral the funder can touch to the price it can charge, the pitch it can make, the pressure it can apply, and the payments counsel can unwind when one funder was preferred over the rest.

Secured Party Possession After Default

After default, before any court has ruled, the secured party may take the collateral without asking. Under the text of the possession statute, section 409.609 of the Wisconsin Statutes, a secured party after default may take possession of collateral and render equipment unusable on the debtor premises (which funders will describe as routine collateral management), through judicial process or without it where no breach of the peace occurs, and may require the debtor to assemble the collateral at a reasonably convenient place.

This is the self help boundary for blanket lien lenders and receivables funders. Counsel reads the security filings first and argues about the balance second. Resist the urge to surrender equipment the secured party has no order to take, even briefly. Breach of the peace voids the shortcut. I have yet to see a blanket lien schedule the owner had actually read before signing.

The Twelve Percent Contract Ceiling

Before the first debit, before the owner understands the schedule, the twelve percent ceiling already constrains the price. Section 138.05 of the Wisconsin Statutes permits no person to contract for, take, or receive more than $12 per $100 per year on the declining principal balance, with statutory equivalents for precomputed installment contracts, corporate and business carve outs in the remaining subsections, and prepayment disclosure rules beside them. The twelve dollar figure is stated in extremely plain terms.

The annotations confirm a revolving plan above 12% is usurious while one percent per month check credit survived challenge, which means the ceiling bites some products and spares others, and commercial borrowers test funder charges against the ceiling with its exceptions rather than assuming the label on the cover decides the outcome. A funder that prices its advance above twelve percent while calling it a purchase has chosen its label more carefully than its defense. The purchase was absolute on its cover page. What the debits collected looked like a loan schedule. The ceiling holds.

Fraudulent Representations and Funder Pitches

The pitch that closed the advance is evidence the moment the advance sours. Section 100.18 of the Wisconsin Statutes bars sellers and advertisers intending to sell or induce a contract for real estate, merchandise, securities, employment, or services offered to the public from making untrue, deceptive, or misleading statements of fact, plan, or price in the state through newspapers, publications, broadcast, and other media, with enforcement through the Department of Agriculture, Trade and Consumer Protection and private remedies.

That is the full inventory of state protection: the paper, the price, the pitch, and the pressure, each assigned to the section that governs it. Wisconsin aims this false advertising statute at deceptive funder, broker, and collector pitches, and the file should preserve every pitch exactly as made (the sweep verifies no published opinion applying these sections to a receivables purchase, which limits what the text alone can promise).

Prohibited Collection Practices

This is the section collectors hope the owner never reads. Section 427.104 of the Wisconsin Consumer Act governs collection of an alleged debt from a consumer credit or other consumer transaction, including agricultural purpose transactions with deferred payment, and bars the collector from force or threats of violence, threats of criminal prosecution, and the further abusive practices the section enumerates.

The provision parallels the federal Fair Debt Collection Practices Act for consumer side obligations, and counsel measures every call and letter against its list. Threats scheduled in order to coerce payment before counsel is retained supply the counterclaim that funds the settlement. Whether a receivables funder collecting its own purchased account counts as a collector under this chapter stays open.

Property Exempt From Execution

Rarely does a collector recite the exemption statutes before seizing. Section 815.18 of the Wisconsin Statutes directs courts to construe its protections to the full benefit of debtors, then itemizes exempt personal property and benefits across its subsections, subject to purchase money, security interest, lien, and support limitations.

The statute reads the way a winter pantry reads: stocked against a siege the owner hopes never comes. Any admission to a collector, even casually, narrows what these exemptions later preserve. This is the collection floor for individual guarantors.

The Homestead Exemption

The homestead section rewards the owner who claimed it before the judgment arrived. Section 815.20 of the Wisconsin Statutes exempts the resident owner selected and occupied homestead from execution, judgment liens, and owner debts up to forty thousand dollars, except mortgages, laborers, mechanics, and purchase money liens with taxes alongside them (the verified figure is the 2001 archived amount of forty thousand dollars, and later acts are reported to have raised the cap without verification in the sweep, so counsel confirms the current figure before any exemption is claimed).

Temporary removal with intent to reoccupy leaves the exemption unimpaired, as does sale with proceeds held toward a replacement homestead for two years. The cap may have moved. Counsel ensures the exemption is claimed before seizure rather than after it.

Voidable Preferences in Creditors Actions

Within the creditors actions chapter, the unwinding mechanism for eve of assignment payoffs lives in section 128.07. Section 128.07 of the Wisconsin Statutes treats an insolvent person transfer or suffered judgment enabling one creditor of a class to obtain a greater percentage than others of the same class as a preference, with recipient and transfer definitions plus avoidance mechanics in the following subsections. A confession of judgment favoring one funder fits the pattern the chapter unwinds.

A threadbare confession clause favoring one funder over the rest is exactly the transfer this chapter reaches, and the preference window is extremely narrow and extremely fact bound. Counsel reads the agreements, traces the debits, and builds a reply that answers the paper, the price, and the pressure behind them.

Engaging Settlement Help Under Wisconsin Law

Steps the owner takes, or does not take, within days of default decide which of the seven sections matter most. Delancey Street, a settlement company and not a law firm, extends a confidential initial review. Simply bring every agreement, filing, and processor notice to the first conversation, and consultation is where this conversation begins. Counsel ensures exemptions are claimed before seizure and preferences reviewed before positions harden. The objective is to ensure no statement is made without counsel present. The statutes wait for no one, and the file built earliest costs the least to finish.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
