A judgment against the business does not close the market for consolidation credit. It reprices that market and narrows it to lenders who understand what a judgment controls and what it leaves alone.
Before the next application leaves the desk, the file should be read the way an underwriter will read it. The judgment sits inside a larger record of revenue and conduct. That record decides the answer.
Experian guidance on business credit reports explains that business bureaus compile reports from creditors, vendors, public records and court filings, and collection agencies. A judgment entered against the company can appear in that record where a lender will find it. Business scores rest on different information than personal scores, so the owner should examine both reports as separate documents.
Retrieve both reports before applying. Resist the urge to estimate the balance from memory where the docket states it exactly. Confirm the caption, the court, the amount, and whether the entry shows the judgment satisfied or open. Fourteen pages of dunning letters prove nothing about the docket. The report and the court record prove the status, and the application should match them exactly.
An open judgment tells a lender that another creditor holds a court ordered claim on the same cash the new loan would rely upon. The lender then asks the question every offer turns upon: after existing obligations are paid, does enough remain to service new debt through its term. Often we see owners answer that question from memory, which is extremely generous to the business and extremely unpersuasive to the reviewer.
OnDeck qualification guidance lists a minimum of one year in business, a minimum of $100,000 in annual revenue, a minimum 625 personal FICO score of the owner, and a business checking account, with a soft credit check at the eligibility stage. A judgment does not erase that analysis. It enters as a competing demand on the account from which the lender expects payment, and most debt buyers know exactly what they are purchasing when they price that risk in order to survive the judgment ahead of them. They prefer not to examine it too closely.
The truth owners resist is that consolidation while an unsatisfied judgment remains enforceable may move collection pressure among creditors without reducing the total burden. That is the arithmetic the underwriter performs. The owner should perform it first.
Simply prepare a monthly forecast of receipts, operating expense, and every continuing payment including any plan on the judgment. Show the remainder. The remainder takes longer to face than the docket number takes to memorize.
Some judgments arrive without trial because the owner signed a confession at funding. The New York confession of judgment statute permits entry of judgment without an action upon an affidavit executed by the defendant stating the sum, authorizing entry, and stating the county of residence with facts of the debt. Counsel checks the affidavit, dates, and county before advising on challenge.
The judgment is enforceable. It may also be defective. Both statements can be true of the same filing, and the file must be examined to learn which description fits.
Exceptions exist, though in practice they tend to confirm the rule. The statute is not entirely clear on every combination of residence and filing county, which is part of the problem the reviewer must work through. Do not assume a confession is void because it feels unfair. Treat it as effective until counsel demonstrates otherwise, and discuss it with no one at the creditor office, even casually, before that review.
A consolidation lender facing a judgment borrower protects the new advance with collateral and the owner personal promise. The same OnDeck guidance describes its term loan as secured by a general lien on business assets, backed by a personal guarantee, while taking no personal assets as collateral. The rate reflects the risk. The lien and the guarantee enforce it.
The balance the owner discusses is rarely the balance the collector sees.
The owner totals principal. The collector totals principal with fees, costs, and interest to date. Whether the court intended this gap or merely failed to prevent it is a question worth considering. The application must use the collector figure, since the lender will.
Ask each prospective lender, before authorizing review beyond initial eligibility, what security it will file, what guarantee it requires, and what happens to the prior judgment at funding. Some lenders pay the judgment creditor from proceeds. Others fund the borrower and trust the borrower to satisfy it. The drifting reality is that the second arrangement often leaves the judgment open, because the owner directs the cash toward operations that screamed louder that week. Get the disbursement mechanics in writing and ensure the payoff reaches the judgment creditor directly where the lender permits it. If we are being precise, the loan is not a consolidation until the old obligations are actually retired.
SBA guidance on 7(a) loans lists refinancing of current business debt among the permitted uses of proceeds. Eligibility turns on an operating business, credit history, a reasonable ability to repay, and operations that meet program requirements. The application runs through a participating lender rather than the agency itself.
The file here is the same file. Tax returns, bank statements, a schedule of debts with the judgment identified, and a forecast that absorbs the proposed payment. The program does not waive underwriting because the purpose is virtuous. It applies the same tests with a federal guarantee behind it.
Gather the agreements, the judgment with its affidavit where one exists, both reports, twelve months of bank statements, and the forecast. Review and analyze the ledger against the statements and protect and preserve every satisfaction and release where the bookkeeper can locate them.
Delancey Street offers an initial review without charge, held in confidence, for owners weighing consolidation against negotiation. It is a debt settlement company rather than a law firm, and legal questions receive attention from independently licensed counsel. Eligibility of the account should be confirmed at the outset. Steps the owner takes, or does not take, in the week before applying decide whether the file coheres.
You sign the paper and then you learn what the paper requires. The peculiar comfort of a complete file is that it answers the underwriter questions before they are asked. We ensure the presentation states what is owed, what is open, and what the cash supports. Consolidation with a judgment on record succeeds where those answers cohere, like any application that asks a stranger to trust figures the owner has faced.
Most funders accept 30–60% as a full settlement — with proper leverage.
