The first question is not what the guaranty says but what the underlying transaction financed. Chapter 2950 covers proceedings to enter judgment by confession for money on an authorizing instrument, and it expressly excludes instruments executed by a natural person in a consumer credit transaction, meaning credit for money, property, or services used primarily for personal, family, or household purposes.
A guaranty tied to a consumer purpose obligation cannot support a confessed judgment. The rule defining the scope of confession practice draws the commercial boundary. Seldom does a threshold question resolve as much as the consumer classification. The exclusion works like a bouncer who checks purpose rather than identity: once the transaction financed a household, the signature buys no deference.
In 1996 the chapter took its current shape, and the entry method has held steady since. The action starts by filing a complaint with the prothonotary. What the creditor filed, or failed to file, decides whether later rules come into play.

Most creditors who file these complaints know no judge reads them first, and they count on that. No notice to defend accompanies the filing, and no responsive pleading is required. An outlandish computation, where one appears, draws the first attack, and defects in any averment supply the classic grounds for striking the judgment. The complaint rule rewards the reader who checks each element in order. The entire practice rests on paper no judge reviewed before entry, and everything after is an attempt to supply the missing scrutiny.
But the judgment holder cannot move to seizure without warning. Before executing, the creditor must serve written notice in the prescribed form at least thirty days before filing the execution praecipe. Service runs through the sheriff, a competent adult, or mail sent by the plaintiff, with alternatives ordered by the court on failure. An extremely quiet entry is followed by an extremely short fuse. The warrant clause rarely draws attention until the account is frozen, and there is no one to blame for that.
The execution praecipe must certify notice, and the thirty day petition clock runs from that notice. The creditor sequences confession and execution in order to present a frozen account rather than a lawsuit. The pre execution notice rule creates the warning window before attachment against the operating account. Rarely does a thirty day period carry as much weight as this one. Resist the urge to call the funder to explain, since any explanation, even casually, narrows what the petition can later contest.
Relief runs by petition joining all strike and open grounds, save the involuntary waiver ground reserved for stay requests. Venue lies in the county of entry, any transfer county, or any county where the sheriff holds a writ. A petition after notice is due within thirty days absent compelling excuse. The judgment entered in compliance with the rules. It is also vulnerable.
The warrant clause (which the industry describes as a bargained efficiency) hands the creditor a judgment before any dispute exists. The procedure runs without a prior hearing, which explains why the petition practice carries the weight it does.
