Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
A claim against a moving or towing business does not establish ownership of every vehicle in the yard. The owner should identify the fleet, the property held for customers and the documents supporting each asserted interest before deciding what can fund a settlement.
Prepare a vehicle schedule from the actual records. Match each truck to its title, financing agreement or lease, and identify the entity that owns or uses it.
A vehicle parked at the premises may belong to a customer, a related company or a lessor. The business should not include it in an asset proposal merely because the unit appears in an operating inventory, though the dispatcher list often becomes the starting point for the schedule, until the owner discovers customer tows and employee vehicles mixed into the list.
Separate the fleet of the towing company from vehicles held in connection with towing or storage work. Rights concerning charges on customer vehicles require their own state law review and run in the opposite direction from funder claims: the possessory protections of a tower secure the charges of the tower rather than supply a funding party with collateral.
Record balances claimed by vehicle lenders and retain payoff correspondence. In a hypothetical schedule running to three pages, two units on the first page might belong to other parties.
If a title or agreement is missing, identify the gap before presenting the asset as available. A settlement discussion can proceed with an unresolved question stated. That should not become an assurance.
New York UCC Section 9-315 addresses continuation of security interests in collateral and identifiable proceeds, subject to authorization and exceptions. The actual collateral grant and applicable law determine whether that framework affects a particular transaction.
Vehicle title rules can require analysis beyond a general UCC search. Counsel should identify the relevant perfection and priority rules rather than assume that a blanket filing and a title lien operate in the same way. The filing is on record. The priority is not.
Compare the entity named in the grant with the entity owning the truck. An individual guarantee should be reviewed on its own terms.
Before offering a fleet asset for sale, before promising the price to an MCA claimant, identify the consents and releases needed from other parties. Retain notices asserting a claim against specific vehicles, since counsel needs to know what has been demanded against the company and under which agreement. Whether the demand letter overstates the grant deliberately or from haste is a question worth considering.
Identify the coverage associated with the event involved: damage to a truck of the company, customer property, or liability to another person. Retrieve the policy, relevant endorsements and correspondence identifying the claimed payment.
If insurance funds are expected after a vehicle loss, determine what work is required to return the truck to operation. A debt proposal should not assume the entire receipt is surplus while the business still needs the vehicle repaired, and any replacement plan should explain how old obligations end.
Ask counsel to review and analyze any asserted security interest in the payment (the funding party, which describes insurance receipts as proceeds with confidence the policy language rarely supports, may assert an interest the documents never granted). The existence of an advance does not establish the funder as a payee under the policy.
A leased vehicle requires review of the lease before the owner agrees to sell or transfer it. Possession and use do not establish authority to dispose of the asset.
But the forecast must still show the actual allocation after the relevant rights have been examined. Resist the urge to count an anticipated insurance payment twice, once as the source of repairs and again as a settlement fund.
Where a payment remains contingent on the decision of the insurer, state the condition. The proposal should not rely on a date that neither the owner nor the settlement adviser can control, and adjuster timelines are not uniform enough to assume.
Delancey Street offers a free confidential initial review of MCA concerns. A moving or towing operator can present the advance documents with the vehicle and cash schedules, including assets whose status remains unresolved.
The company provides debt settlement services and coordinates legal matters with independent counsel. It is not a law firm. Vehicle title, insurance and regulatory disputes require the appropriate professional engagement.
Ask the adviser to ensure that the settlement forecast preserves the operating costs needed to complete work. Counsel should ensure that proposed asset dispositions receive the necessary review, and steps taken, or not taken, in the first weeks after default shape the posture of the case against the operator.
The New York procedure for termination of a financing statement gives the parties a statutory path to confirm release rather than rely on a payoff letter alone. An extremely common error is treating the payoff letter as the release. Most operators postpone the title review until a buyer asks for it. The delay is understandable.
Review fees and the treatment of each account. Rarely does one funding party agreement release a vehicle lender claim or a separate undertaking of the owner.
Keep title documents, account statements and insurance correspondence with the relevant vehicle record. Retain received legal papers in full.
Simply route new notices to the assigned professional. A collection message and a coverage decision from the insurer require different responses.
File accepted changes with the agreements they modify, and consult and contact the assigned professional when demands escalate.
Compare remaining capacity and expenses with the revenue supporting future installments. We review the terms, identify the deficiencies, and construct a response that addresses both the contractual claims and the practical realities of the fleet.
An extremely favorable discount may remain unsuitable if it requires disposal of the only asset capable of producing the promised payments. The advance company drafted its default notices in order to present every unit in the yard as available collateral. Any negotiation with the claimant, even casually, can narrow options before counsel has reviewed the title position.
In most of the fleet matters we have seen, though the sample is not scientific, the owner overstates available equity at the outset. The outlandish demand letter and the careful title schedule rarely describe the same fleet.
Consultation with Delancey Street is where this conversation begins for operators facing several obligations at once. The useful result is a debt plan that recognizes which vehicles belong to the business and what the business needs those vehicles to do, a discipline that applies well past the industry that produced it.
Most funders accept 30–60% as a full settlement — with proper leverage.
