A levy moves property or it expires. Nothing in the statute permits the debtor to wait out the clock.
The execution is the instrument the officer enforces, and its face should match the judgment. CPLR 5230, governing executions, requires the execution to specify the court, the entry date, the amount, the parties, and the last known address of the named debtor, and to direct levy only on property in which the named debtor holds an interest or debts owed to that debtor. Simply examine and compare the execution with the judgment before answering any demand. An extremely common error treats a collection letter as an execution.
Executions issue from the supreme court, county court, or family court of the county of first docketing, by the clerk or by the creditor attorney as officer of the court, to the sheriffs of one or more counties. A creditor may direct executions to several counties at once, in order to reach property wherever the debtor holds it. The statute speaks of sheriffs. Where a city marshal acts in New York City, counsel confirms the local authority behind the paper, since whether a given marshal paper rests on equivalent local authority is a question the captured text does not answer.
And the officer keeps records. Each sheriff records executions delivered, with parties, dates of issue and return, delivery time, and amounts due and unpaid. An execution returns to the issuing clerk within sixty days unless served under the levy provisions, and the creditor attorney may extend the period in writing.
Levy by service reaches what the officer never touches. Under CPLR 5232, governing levy on personal property, the sheriff levies on property not capable of delivery and on debts owed to the debtor by serving the execution on the garnishee in the manner of a summons. Levy by seizure takes property capable of delivery into custody, followed by service of a copy on the person from whose possession it was taken.
The notice to the natural person debtor follows within four days of service on the garnishee, in an envelope marked personal and confidential, where the execution does not show the statutory notice was served within the prior year. What the sheriff serves, or fails to serve, within those four days shapes the debtor response.
Often the debtor reads ninety days as permission to wait. Ninety days measure the creditor effort, not the debtor reprieve.
The garnishee must transfer the property and pay the debts on maturity to the sheriff, with any document necessary to effect the transfer, and until that transfer or payment, or until ninety days expire, or until a court order served on the garnishee extends the period, the garnishee is forbidden to sell, assign, transfer, or interfere with the property, or to pay the debt to anyone other than the sheriff, and at ninety days the levy is void except as to property or debts transferred or paid or as to which a turnover proceeding has been brought.
The levy is void. The judgment survives.
Levies announce themselves on weekday mornings, when the card declines and the portal freezes. The whole of post judgment enforcement is the creditor attempt to convert paper into money before the paper expires. That decides whether settlement talks concern a live levy or a dead one.
A careless specification in the notice becomes a damages claim against the creditor, so counsel compares the property described with the property the debtor actually holds.
A bank account levy follows the levy rules plus an additional procedure. Where the levy reaches a natural person account at a banking institution, the sheriff serves the exemption notice and two claim forms simultaneously with the execution, and CPLR 5222-A, the exemption claim procedure, governs what follows.
The bank holds the funds for at least twenty seven days (the captured text reflects the hosted revision, and counsel confirms the current section before relying on it). Thirty days after service, the bank may transfer the funds if no claim form and no court order has arrived. The calendar rewards the debtor who files the form and the creditor who watches for it.
The exemption notice procedure serves natural person accounts. An LLC operating account should not be assumed to inherit its protections because the owner draws a living from the business. Business receipts described as exempt wages persuade no court and embarrass the counsel who presents them.
Nobody budgets for a levy. Gather and keep every confirmation the process generates, and record the amount transferred, the credit shown against the judgment, and the date on which each paper moved from one hand to the next.
Money unavailable to the owner is not money received by the creditor.
Delancey Street offers a free confidential initial review of MCA and business debt concerns. The company provides debt settlement services and coordinates legal matters with independent counsel. It is not a law firm.
Ask the adviser to ensure any proposal states what changes about the levy and what remains due. Counsel should ensure the release or modification arrives through the required documents. An extremely favorable reduction solves nothing if the account stays restrained while installments come due. Any side payment to the creditor, even briefly discussed, should be documented before it is made.
Resist the urge to promise restrained funds as an installment. The levy lifts by transfer, by court order, or by expiration, and only the file shows which event occurred. Enforcement ends the way it began: with papers, read in order, answered in their own forum.
Most funders accept 30–60% as a full settlement — with proper leverage.
