Collection after judgment proceeds through papers, not through predictions. The judgment fixes the parties and the amount, and each later measure arrives as a separate document.
The worst error arrives first, when the owner treats a company judgment as a personal one or mistakes a guaranty judgment for the end of company exposure. Retrieve the entered judgment with the court record behind it, and confirm the case number, parties, and amount before answering any collector account.
A judgment against the operating company never establishes, by itself, a judgment against every owner, and a judgment against a guarantor never answers what remains against the company. Counsel sorts that question from the caption and the signed instruments. If the owner learned of the case through a bank restriction, that notice and its envelope stay with the file.
New York CPLR 5004, the interest rate statute, sets interest at nine percent per year except where statute provides otherwise, and the two percent rate belongs to consumer debt of a natural person for household purposes. A business MCA presumptively takes nine percent, though the characterization of a particular guaranty is a question for counsel.
In 2021, the amendment introduced the two percent consumer rate without reopening amounts already paid. That is the history the creditor letter never mentions. Counsel obtains a ledger of payments and added amounts, and compares the creditor figures against the docket entries before discussing any payoff figure.
CPLR 5222, governing restraining notices, permits issuance by the court clerk or by the creditor attorney as an officer of the court, and disobedience is punishable as contempt. The notice forbids transfer of property interests held by the debtor, and where a bank account is restrained, the exemption notices and claim forms decide whether it holds.
Determine who received the notice and which property it names, since effect and duration differ between the debtor and another person holding the funds. Resist the urge to answer a restraint by moving the affected funds elsewhere.
You learn the restraint exists when the card declines or the portal shows a balance the owner cannot touch. That particular quiet, the money visible and unreachable, is where the enforcement case against the business turns real.
CPLR 5224, on subpoena procedure, calls for sworn answers returned with the original questions within seven days after receipt. Identify which paper arrived instead of treating every request as an informal questionnaire.
Simply gather the records needed for an accurate answer, without inventing a balance or omitting an unclear account. The envelope stays with the questions, and counsel reviews service, scope, and timing before anything is signed.
CPLR 5232, on levy upon personal property, reaches property and debts in the garnishee hands through the sheriff service of execution. Identify the execution, the recipient, and the date, since the court file decides what is pending rather than the collector description of everything frozen.
CPLR 5225, on payment or delivery of property, grants turnover by motion where the debtor holds the property and by special proceeding where another holds it. A turnover demand never equals an entered order. The restraint restricts. It does not collect.
And the payroll falling due during a restraint creates no exemption of its own, which means the offer cannot name the restrained balance as its source without an agreed release, though parties often negotiate both together, and files stall when neither side commits its step to writing first.
An extremely useful review names the pending procedure and the authorized person, and restraints often arrive, if memory holds, on a Friday afternoon. Whether the court intended that pressure or merely permits it is a question worth carrying into the conference.
The commercial discussion only helps when the numbers underneath it are honest. Delancey Street offers a free confidential initial review of MCA concerns. The company provides debt settlement services and coordinates legal matters with independent counsel. It is not a law firm.
Ask the adviser to ensure that the proposal addresses the existing judgment rather than the original balance alone. Counsel should ensure that any agreed release, pause, or satisfaction document receives the required treatment.
Notices often arrive in clusters in order to force a call before counsel is retained, and any statement to the creditor, even casually, can narrow the options.
I have yet to see a bank release funds on a telephone call. Few owners read the satisfaction language before signing, and the omission is understandable. The docket keeps the papers; only signed documents change them.
Payment confirmations stay with the judgment file, and written agreements stay with the confirmations. Forward every new paper to counsel at once, since an earlier negotiation never answers a later notice. Counsel works from the current file.
The judgment was final. It settled nothing about collection. Read the settlement for its treatment of the judgment and each active enforcement measure, since an extremely favorable discount remains incomplete while those subjects stay unresolved.
Consider a hypothetical owner who pays the collector by telephone and discards the receipt. The payment posts nowhere the docket recognizes, and the restraint remains until a written credit releases it.
Most buyers of judgments know exactly what they purchased, and they prefer not to examine the accounting too closely. What the creditor discloses, or withholds, decides the next motion, and rarely does a single payment end a file where an outlandish balance grew from unitemized fees. We review the terms, identify the deficiencies, and construct a response around the judgment and the cash the business must protect.
Delancey Street review can open the commercial discussion while counsel addresses the court process. Consult and contact both early. Judgments close files only when the documents say so, and the docket records what the parties wrote.
Most funders accept 30–60% as a full settlement — with proper leverage.
