Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
The amount required to close an account should be fixed before funds leave the business. Several entities may have supplied different balances, or the proposed transfer may include a discount whose conditions no one recorded.
A payoff request asks the recipient to state its position in a form the owner can check. It does not establish a universal right to a particular format or response period, and the agreement, the provider process, and the applicable law each require attention before anyone relies on the figure.
The written figure is only the beginning. The business should also determine what the payment resolves, who holds authority to receive it, and which completion documents follow after the transfer clears.
Use the legal name of the business with the agreement date and the account reference. If a modification or renewal changed the arrangement, identify that document as well so the recipient prices the correct obligation.
The intended payment date matters because a quotation may be limited to a particular period or subject to specified conditions. Ask the recipient to explain how the amount changes if payment arrives later, and do not assume that a balance shown in a portal is a final payoff quote.
Where several advances exist, request separate accounting for each agreement. A consolidated demand should still permit the business to identify the amounts and obligations included, and the owner should confirm which advance each payment will satisfy before authorizing a single transfer. There are exceptions, though in practice the consolidated figure tends to conceal the allocation the owner needs most.
The request should name payments already made and ask the recipient to explain additional charges. An itemized statement is easier to evaluate than a single amount described as everything owed, and the owner should insist on the breakdown before discussing discounts.
For an advance of future receivables, use the agreement terminology. The purchased amount, the remittances, and the contractual charges may not correspond to a loan of principal with interest, so ask the recipient to explain the calculation without imposing the wrong model on the transaction. Reconcile the statement with the business records, including payments made under a modification or an earlier proposed settlement, and identify any transfer the response omits.
A reversed or returned payment may require separate explanation. Compare bank records with the recipient ledger before declaring either one wrong, and where the demand includes legal fees or other costs, ask for the contractual basis with the calculation. Requesting that information does not decide whether the amount is recoverable. It creates a question counsel can assess under the agreement and the applicable law.
The same approach applies to a disputed discount. An owner may recall that a representative offered a reduction without knowing its conditions or expiration. Locate the communication and ask whether the written payoff incorporates it. And when the calculation is corrected, request a revised quotation rather than relying on several messages that amend separate portions of the first one.
Consider language in this form, adapted to the facts: Re: business legal name, agreement date, and account reference. Please provide the amount the company requires to satisfy the identified obligation if payment is received by the stated date, with the period for which the quotation remains valid and any conditions affecting the amount.
Continue: please provide an itemization showing the calculation, all credited payments, and the basis for additional charges. Please identify the party entitled to receive payment, the authority to provide the quotation, and the completion documents to be supplied after payment, with the response directed to the designated contact.
If the owner offers less than the asserted balance, describe that as a settlement proposal rather than suggesting the reduced amount is an agreed payoff. The recipient must understand whether the business requests information or proposes different terms. Counsel should review correspondence where liability or an existing lawsuit is disputed.
A company balance and an individual guaranty need separate attention. The owner should ask whether the proposed payment resolves the guaranty and which document confirms that result, rather than inferring the answer from words such as paid in full appearing in a receipt.
The New York statute on written releases does not supply obligations or parties absent from the release text. Counsel should examine the promised scope instead.
A financing statement requires its own completion process. The New York statute on termination of financing statements imposes termination duties under specified conditions, including requirements applicable to filings against nonconsumer collateral. Ask who will perform the required action and how the business will obtain confirmation, and where the payment resolves a single obligation among several secured debts, seek additional analysis rather than assuming every filing against the business must terminate.
Payment does not tell the docket what occurred. A pending action requires the disposition the parties agreed upon with the appropriate filing, and the New York rules on voluntary discontinuance supply the procedures with a default rule concerning prejudice that counsel should address in the document.
For an existing judgment, ask counsel to address satisfaction and the relevant records. Keep confirmation with the payment evidence. The administrative work should be assigned before the transfer rather than left for the owner to pursue after the recipient holds the money, since attention paid before payment costs less than attention chased afterward.
Payment instructions should be verified through a contact method the business already trusts. Confirm the recipient and the reference information before using new banking details supplied in an unexpected message, since diversion of a payoff transfer creates a loss the underlying dispute never contained.
After payment, obtain confirmation that funds were credited as agreed. Retain the quotation, any executed agreement, the transfer evidence, and the documents completing the release and filing obligations in a single closing file.
Delancey Street offers an initial discussion of MCA settlement possibilities through its debt settlement service. The company acts as a settlement company, and independent counsel handles legal work. Confirm scope and fees for any proposed engagement. A written balance helps the owner decide whether payoff or negotiated resolution is feasible.
The durable result is a record showing both what was paid and what the payment concluded. That record, more than the quotation that preceded it, is what closes the account.
Most funders accept 30–60% as a full settlement — with proper leverage.
