A fee quotation becomes useful only after the attorney names the work it purchases, because an inexpensive engagement can leave the consequential part of the dispute outside its scope.

Two proposals can share a billing label and cover different services: one may address negotiation before litigation while another includes an answer to a complaint but excludes discovery, motion practice, and any appeal. The figure beside the word retainer resolves none of those differences. The scope of the engagement is the entire subject.

1. Hourly billing and the assignment it prices

Ask the proposed attorney to name the first stage of work. Reading the agreements, assessing a filed complaint, and communicating with the funder are distinct tasks, and a budget for initial assessment should not be mistaken for an estimate covering the dispute. The engagement should state billing increments with the rates of each professional whose time may appear on an invoice, separating legal fees from expenses, since filing charges and outside services can move the total while the quoted rate stays fixed.

Litigation creates work absent from the opening discussion, and an amended pleading, a disputed service issue, or a new application by the opposing party can require a revised budget. There are exceptions, though in practice they tend to confirm the rule. The point of defining the assignment is to expose those possibilities before they arrive as line items.

2. Flat fees and the boundary of the promise

Certainty about a defined service is what a fixed amount can supply. The uncertainty moves to the boundary of the promise: what counts as completion, which events fall outside the assignment, and what happens if the dispute changes shape.

A proposal might cover a specified negotiation phase, though the drafting of the settlement document itself can fall outside it, if we are being precise about where negotiation ends and documentation begins. Ask whether preparing the agreement is included, whether counsel will review the funder draft, and who handles any filing required after signatures. These questions describe the work. They presume nothing about any particular firm.

3. Staged engagements and the trigger for each charge

A staged engagement assigns a price or billing method to successive portions of the matter, helping the business decide whether to authorize further work after the initial assessment. That decision point is the purpose of the design.

The stages need to correspond to recognizable deliverables. Contract analysis, negotiated resolution, and litigation through a particular event are different assignments. Labels such as phase two mean little without the accompanying description, with the trigger for the next charge visible beside the service it concerns.

But the number the owner remembers is the first one, and a staged quotation can mislead without anyone misstating its opening price. The owner recalls the initial amount while the dispute requires several stages. Compare the expected sequence as well as the first payment, and keep the scope of each stage beside its price.

4. Capped arrangements and the meaning of the ceiling

The document must state what the ceiling includes before a cap means anything. A cap on professional fees can leave expenses separate. A cap for one stage need not extend to later work.

Ask whether additional authorization is required before exceeding the limit and what happens if the work cannot be completed within it. 5. Hybrid and outcome measured proposals

Some proposals combine billing methods or connect part of the charge to an outcome. Before comparing such an arrangement with a fixed amount, ask the attorney to explain the calculation and whether the structure is permitted for the proposed representation, since ethics rules constrain certain outcome measured charges.

A charge measured against savings needs a starting balance, and if the funder demand contains disputed fees, the engagement should explain whether those fees enter the calculation. The result can change without any difference in the settlement payment.

That figure concerns consumer settlement firms rather than MCA counsel, and it earns its place here as context for two questions every percentage quotation should answer: what base the percentage applies to, and when the obligation to pay it arises.

Timing deserves the same attention: determine whether the charge becomes payable when an agreement is signed, when the client completes the settlement, or under another stated condition, since the cash obligation can arrive before the business has finished paying the creditor. An example using the actual figures of the client is more useful than a general assurance that incentives align. 6. The settlement company engagement beside the attorney engagement

Under New York procedure on service of pleadings, response timing follows rules that turn on how papers were served. Negotiating a fee does not itself answer a complaint. An owner should ensure that an identified lawyer has accepted responsibility for the immediate deadline, and ensure no one assumes a consultation created that responsibility.

Recommendations deserve a question about compensation (referral payments behind endorsements require disclosure under the federal endorsement guidance on material connections). Ask who receives value for the referral and whether the recommendation would survive without it.
