A funder holding a signed MCA agreement and no judgment holds no power to freeze a personal bank account. The restraint owners describe arrives by one of two routes: debit rights signed at funding, or court process issued after judgment.
Before counsel can advise, the question is which event occurred. The answer sits in the paper the bank received, not in the collection call.
Behind every restriction stands an instrument, and counsel needs that instrument before anything else. A stopped transfer can reflect an agreed debit, a processor hold, or a restraining notice served after judgment. The account alert explains none of these with precision.
New York CPLR 5222 authorizes a postjudgment restraining notice against property of the judgment debtor. The notice may issue from the clerk or from the creditor attorney as officer of the court, a peculiar delegation that excuses a missing judicial signature. Most funders understand the difference, and prefer the owner not to examine it.
No restraint dispute I have seen ended at the bank telephone line, though owners call there before calling counsel. The bank letter arrives something like a week after the freeze, in our experience, though institutions differ.
Most owners learn of the restraint from a declined card. That moment is worse than the paperwork that follows.
CPLR 5222-A governs a restraint on the account of a natural person. The issuer must serve the bank with an exemption notice and two exemption claim forms with the restraint. Failure to serve that packet voids the restraint, and the bank is directed not to restrain the account.
The statute protects identifiable exempt payments through a 45 day lookback. Where reasonably identifiable exempt payments arrived by direct deposit in the 45 days before service, the bank must leave 2500 dollars unrestrained. An account holding no more is not restrained at all.
A second layer of protection is measured by wages rather than source. A restraint does not reach amounts at or below 240 times the federal or state minimum wage, except funds a court finds unnecessary for reasonable requirements. The formula is the protection, and no old dollar figure should substitute for the calculation under current wage law.
A restraint served without the exemption packet is void.
Filing a claim form begins a process rather than completing one. The claim form is an extremely modest document for the work it performs. Preserve the forms, the envelope, and the statements needed to trace exempt deposits. Counsel should review and analyze the claim before forecasting access.
Every joint account invites the same two errors. The creditor reads the second name as decoration; the family reads it as a shield. Some questions turn on deposits, some on the account agreement, and spousal rights against the debts of the other holder belong to the law of the governing state.
The creditor argues that the balance belongs to the debtor because the statement bears the name of the debtor, the family argues that the balance belongs to the spouse because the wages of the spouse filled it, and the account agreement, unread since the day the account was opened, contains the deciding language. Rarely does either side read that agreement before the dispute.
Marriage answers no debt question by itself. Where the spouse signed nothing and appears in no judgment, the creditor needs a basis beyond the household. Where the spouse signed a separate undertaking, that document controls the change, and counsel reads it for the obligation covered and the procedure of enforcement. Read it with attention to dates and signatures.
Moving the balance before asking counsel protects nothing, since the restraint may reach property arriving after service, and the ownership records behind a future claim now carry a gap. Resist the urge to move funds when the restraint lands.
Some transfers after notice cause no harm, though in practice the exceptions are narrower than owners expect. That is cold comfort with the account frozen.
The notice named the company, yet the bank froze your account. Retrieve the judgment and read the caption before conceding that those facts belong together. A judgment against the operating company creates no personal judgment against the owner, and no restraint on company property reaches a personal account without a further basis.
Where the creditor relies on a guarantee, the undertaking and the court history require examination together. A signature establishes that a document was signed. Scope and adjudication are separate inquiries that the collection call treats as one. A collector may blur that distinction in order to present the guarantee as a judgment.
Sixteen months after funding, or six weeks after the last payment, the posture is whatever the docket shows. Counsel compares the parties named in the judgment with the holder of the restrained account, and the comparison either supports the restraint or exposes the gap.
The caption is the answer.
The funds may still be exempt. The restraint may have issued in proper form. One does not defeat a restraint by ignoring the packet.
The bank mails the packet to the last address on file. Two restraining notices per year is the limit against a natural person account. The restraint runs one year unless the judgment ends within that period. Record whether funds remain held and retain confirmation of any credit applied. Discussion with the collector, even briefly, should wait for counsel.
Whether the MCA obligation can be resolved within available means is a question for a settlement assessment with Delancey Street. Delancey Street is a settlement company, not a law firm, and independent counsel handles the ownership questions, the exemption claim, and whether the release reaches the personal account.
Ask the adviser to ensure the settlement funds are available for the intended payment. Counsel should ensure the ownership and exemption issues receive full legal treatment. The attorney reviews the judgment, traces the deposits, and constructs the response the papers support.
An extremely common error treats the company judgment as a personal one. Steps taken, or not taken, after notice shape the exemption claim. Negotiation can proceed while the restraint stands. Early action can protect and preserve the exemption claim.
Simply preserve each new notice as it arrives and bring the complete set to counsel. The restrained balance sits visible on every login, like a photograph of money. That visibility is the pressure of the procedure, and the answer sits in the packet, the claim form, and the deciding court. Protection belongs to the debtor who claims it, and to no account by itself.
Most funders accept 30–60% as a full settlement — with proper leverage.
