An MCA funder claim to an ERC refund requires more than the assertion that the business owes money. The first review should determine whether the refund was intercepted before payment, deposited and then withdrawn, or restrained through a separate legal process.

The IRS guidance on ERC claims describes reviews and disallowances that can affect payment before any private party enters the picture. Those agency events can look identical to a funder seizure on a bank statement. Their legal bases differ entirely. The money left the account. The debt may not have moved at all. A missing deposit sits in the file the way an empty chair sits at a deposition: conspicuous, and explained by no one present.

What Happened to the Payment

Months after the claim was filed, the owner opens the bank portal and finds either money or an explanation missing. A refund expected by a preparer is not evidence that the IRS has sent it.

If funds arrived and left the account, record the transaction description and date exactly as the bank states them. If the issue is an allegedly unauthorized or incorrect debit, contact the bank through a verified channel and ensure its representative states what records and deadlines apply to the business account. No one distinguishes these two collections correctly on the first attempt. Consumer account protections should not be assumed to govern every commercial transaction.
