A percentage of savings is only as meaningful as the balance from which the savings are measured.

A flat amount is only as clear as the work it covers. Neither model determines what the creditor will accept or what the business will retain after all payments, and the owner who compares percentages without reading definitions is comparing advertisements rather than obligations.

Most owners compare the percentages and stop there. I understand the temptation.

What the Flat Amount Covers

A fixed charge can make the cost of a defined service easier to grasp. The important question is whether the defined service corresponds to the work the owner expects, including which accounts are included and through what stage the negotiation is covered (the engagement letter should answer both points without reliance on any verbal assurance given at enrollment).

Ask whether the amount extends through a signed creditor agreement, review of the creditor document, or another stated point. Identify any legal representation supplied under a separate engagement, because the flat figure may exclude the very work the owner assumed it contained.

The agreement should address additional effort. A new lawsuit, an added creditor, or a revised assignment may require a different scope, and the owner should understand that possibility before treating the opening price as the total cost of resolving every issue. A flat amount does not establish that the provider will underperform, and it does not establish that the owner will overpay.

The Baseline Behind a Savings Percentage

The proposed agreement should identify the balance used to measure any reduction. The figure may be the amount asserted at enrollment, a later payoff figure, or another defined amount, and the fee that results from each choice differs even when the settlement payment is identical.

The charge was, if precision is required, a function of the starting number rather than a function of the result. That characterization rarely appears in the sales illustration, though it controls the invoice more than any other term.

A percentage is a fraction. The argument is always about the denominator.

Ask how disputed fees and prior payments enter the calculation. If the starting figure includes a contested charge, the resulting savings can appear substantial without changing the actual payment, and a revised schedule that improves cash flow may be presented as a reduction of the amount owed when those are different results.

The arithmetic was exact. The price remained unknown.

Use the creditor accounting and the business records to understand the starting point. A number copied into an enrollment form should not become unquestionable merely because it appears in the service contract, and the provider should illustrate the fee from the proposed terms with creditor payment and provider charge shown apart. For several accounts, determine whether savings are measured separately or across the portfolio, because a result on one obligation may not describe another, which is an extremely frequent source of later dispute (a narrow file, and not a statistical one).

Whether courts will treat an inflated baseline as a defense to the fee itself is a question worth considering.

Keep the starting statement used in the calculation with the settlement agreement and the provider invoice. If the baseline can change during the engagement, the contract should state what permits the change and how the owner is notified, so the file can be reconstructed without reliance on memory.

A Labeled Hypothetical With Whole Numbers

You sign the schedule and then you learn what the schedule costs.

Consider a hypothetical account with an agreed calculation baseline of $100,000 and an assumed settlement payment of $70,000. The assumed reduction is $30,000, and the figures that follow are illustrative rather than market prices or predictions of any outcome.

If one hypothetical provider charges a $5,000 flat amount and another charges 20 percent of the reduction, the latter fee would be $6,000. The combined totals would be $75,000 and $76,000 respectively, before other costs or tax consequences are considered.

Change the underlying result and the comparison changes with it. That is why a quote should be evaluated with its definitions and responsibilities rather than by the percentage printed beside it, and why the owner should not assume that one provider will negotiate the same agreement as another. The calculation compares stated terms. It supplies no outcome data.

Timing Rules for Collection

A charge due upon execution of a creditor agreement creates a different cash obligation from one due after completion of the payment schedule. The owner should ask what event triggers the fee and what remains payable if the settlement is not completed.

For covered sellers, the federal guidance on the timing of debt relief fees describes required resolution and customer payment conditions before collection. Whether a commercial MCA engagement falls within that rule requires a separate coverage analysis, and a percentage model is not automatically lawful while a flat amount is not automatically exempt.

Funds reserved for creditor payments should be distinguished from fees withdrawn by the provider on a schedule that shows both. The authorization was dated March 4.

Tax Results and Separate Expenses

The IRS guidance on canceled debt explains that cancellation can produce taxable income, subject to exceptions and exclusions that depend on the facts. The tax result is not determined by whether the settlement company charges a flat amount or a percentage, and the tax result is not entirely predictable on these facts, which is part of the problem.

A tax professional should assess the actual transaction rather than a predicted figure. Identify other expenses in the engagement, including any separate legal work, and compute and confirm the complete cost instead of reducing it to the headline charge. Most fee schedules know exactly which definition does the work. They prefer it stays unread.

Delancey Street offers an initial review of settlement possibilities through its business debt settlement service, and its commercial assistance stands apart from legal representation through independently licensed counsel. Before accepting any engagement, the owner should state the starting balance, the fee trigger, and the work included from the documents alone. Steps taken, or avoided, in the week the offer arrives shape the net result against the creditor, who structures demands in order to test resolution before litigation. Simply require that both payments fit the same cash forecast, and ensure the agreement addresses an unsuccessful negotiation with the same clarity it gives to success. I am less certain about hourly engagements than about the two models compared here. The oblique risk is a baseline the owner never verified, and the baseline repays verification before any signature.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
