Full 2026 rankings, city guides, and red-flag checks: Business Cash Advance Settlement.
A home health agency can complete every visit on the schedule and still lack the balance for the morning debit. The useful assessment separates the payer process from the advance terms, with neither treated as an explanation that excuses examination of the other.
Before the next payroll posts, the owner should regard the expected receipt as one figure among several that decide whether the account remains viable. The amount billed does not itself establish cash available for settlement.
Separate Medicare, Medicaid, managed care and private pay accounts in the collection schedule. A rule affecting one payment relationship should not be imported into another because both reimburse services delivered in a patient residence.
In November 2023, CMS issued the calendar year 2024 home health payment rule, and the fact sheet for the 2024 Medicare home health payment rule describes a 30 day unit of payment under that program. That historical framework governs Medicare fee for service reimbursement. It does not establish Medicaid timing, which remains specific to the state program involved.
For a Medicaid account, identify the state program or managed care arrangement and the rules applicable to the claim. The billing professional of the agency should confirm the relevant requirements before a debt proposal relies on a collection date, though confirmation practices vary enough across payers that the owner should ask what the confirmation actually covers. An internal estimate should remain identified as an estimate rather than become a promise through repetition.
The forecast should distinguish the amount billed from the amount the payer has accepted. Whether confusion between the two explains more failed proposals than any other single error is a question worth considering.
Retrieve the claim status and the reason for any unresolved item. Awaiting information, denied on a disputed basis and approved awaiting payment each require a different response.
Identify the records needed to address the issue with the billing and clinical teams, though the request often expands once the file is opened, because a single missing note can implicate the visit narrative and the plan of care until the routine response becomes a reconstruction no adviser can price from a summary. The business should not alter the account of services delivered to make the forecast more attractive.
A debt adviser needs financial information sufficient to understand the available cash. Counsel should protect and preserve the position of the agency while addressing confidentiality and the proper method of sharing information where patient related records are involved. Any statement to the funder about the claim file, even briefly, should pass through that review.
In LG Funding LLC v. United Senior Properties of Olathe LLC, a New York appellate court examined whether repayment under a merchant agreement was absolute, weighing reconciliation terms, the duration of the obligation and recourse in bankruptcy. The decision is a procedural ruling under New York law. It does not establish that a delayed reimbursement suspends every advance obligation.
The reconciliation language in that agreement permitted adjustment upon request at the sole discretion of the funding party, a construction the court read alongside provisions suggesting absolute repayment. The agreement also treated admitted inability to pay as a trigger for immediate full repayment, a feature with significance for an agency whose receipts arrive on a payer timetable.
Read the actual agreement for the definition of receipts, the records required and the response procedure. The clause was, if we are being precise, the entire case in miniature.
The debit resumed on schedule. The claim remained unpaid.
Before budgeting a reduced debit, before promising the resulting cash to payroll, establish what change the funding party accepted. Preserve the submission and the response with the agreement.
An unanswered request is not an amendment.
Delancey Street offers a free confidential initial review of MCA concerns. A home health agency can present the advance documents with a financial schedule showing collected, approved and disputed amounts.
The company provides debt settlement services and coordinates legal matters with independent counsel. It is not a law firm. Health care payment, licensing and confidentiality questions require the relevant legal or professional engagement.
Ask the adviser to review the schedules, identify the deficiencies, and construct a proposal that addresses both the advance claims and the operating costs of the agency. Counsel should ensure that any proposed assignment or change in payment direction receives a review of the applicable restrictions. Steps taken, or not taken, in the first weeks after default shape the posture of the case against the agency.
Consider a hypothetical agency with two advances and a single large payer dispute. The collection correspondence is drafted in order to project certainty about terms the owner has not yet verified. Resist the urge to accept a short accommodation without reading what follows it. Most agencies postpone this review until the account is already strained. The delay is understandable.
Review service fees and creditor communication responsibilities, and consult and contact the assigned professionals before new notices accumulate. Counsel should ensure that the scope letter, rather than the opening conversation, defines the engagement.
Response calendars prevent missed obligations. Record the dates governing payer submissions and legal notices, and assign each item to the person qualified to handle it.
Simply retain the resulting correspondence in separate files. A negotiation with the advance company does not establish an extension from a payer or a court.
Read the consequences of missed installments and the releases promised after performance. Identify how the agency would respond if a receipt supporting the plan remained delayed or disputed, because an extremely favorable discount may remain insufficient where the payment date depends on a decision outside the control of the agency. This is the constraint the offer must recognize.
Rarely does a funder volunteer the full effect of a missed settlement installment. Compare the complete schedule with the payer information the agency can support, and weigh any offset asserted against expected receipts. I am less certain about this than the preceding paragraph might suggest, since some funders state the consequence plainly and the owner overlooks it.
An extremely useful forecast shows the effect of a delayed receipt without assuming that clinical operations can be paused to match it. The visit has occurred even when the payment file remains open, a peculiar arithmetic in which the labor is certain and the compensation conjectural.
Consultation with Delancey Street is where this conversation begins for owners facing several obligations at once. The broader objective is a financing plan that recognizes the interval between providing care and receiving the money, without transferring that uncertainty into a promise the agency cannot keep.
Most funders accept 30–60% as a full settlement — with proper leverage.
