The first useful answer requires the agreement. An owner seeking MCA help can spend hours describing the pressure while the provision governing payment, adjustment, or personal exposure remains unread.

Assemble the account in a form another person can evaluate. The objective is a clear next decision, not a performance of certainty about what the contract means, and the six steps below produce that file.

Name the Immediate Problem

State whether the difficulty concerns cash flow, a disputed withdrawal, a legal notice, or an offer that needs review. More than one may apply, but each deserves identification before scheduling an ordinary intake.

Disclose a summons or other formal deadline at the outset. Counsel may need to assess that requirement while the financial records are assembled, and the next actual date written at the top of the file can improve the order of the conversation.

Simply name the pressure in one sentence and keep the sentence visible.

Assemble the Account File

Gather the signed agreement, amendments, payment history, bank statements, and creditor correspondence, including any personal guaranty. Keep originals intact and supply copies for review, identifying missing documents rather than reconstructing their contents from memory.

Create an index of the agreements by funding date and counterparty (amendments, assignments, and any notice changing the party that services or claims the account, each matched to the deposits and withdrawals it explains, with unexplained entries carried on a separate question list rather than forced into the chronology). The reviewer should be able to identify the obligation now at issue without assuming that the most recent document replaced every earlier one.

Include correspondence concerning requests for payment changes. The date, information supplied, and response can matter to both the commercial discussion and the assessment of counsel, and an organized file should make it easier to examine the facts while keeping the evidence intact.

Whether the funder expects the business to survive the schedule is a question the file leaves unanswered.

Match bank deposits and withdrawals against that index where possible. If a funding amount was reduced by a prior payoff or a fee, identify the supporting statement, since a deposit by itself may not explain the original obligation or the amount still claimed.

The Collection and Reconciliation Record

Compare the contract’s payment mechanism with actual withdrawals. If receipts declined, identify any reconciliation request and the response, because the presence of a clause and its operation may require separate attention.

In LG Funding v. United Senior Properties, a New York appellate court discussed reconciliation, finite term, and bankruptcy recourse when evaluating whether repayment was absolute. The case does not establish an automatic defense for every advance or jurisdiction.

The file was complete. It was also unread.

Counsel can review and analyze the relevance of those issues under the governing law. We would ensure the record includes unfavorable facts as well as supportive ones, since an earlier promise or incomplete submission can matter when advice rests on the whole chronology.

Resist the urge to describe the agreement as void before it has been reviewed. A creditor may assert default in order to pursue collection against the company or guarantor, and the response should rest on an actual assessment rather than a desired conclusion.

The Initial Commercial Review

Delancey Street offers a free confidential initial review of MCA debt concerns. Its debt settlement services provide a place to examine negotiation, with account eligibility and availability confirmed. The company is not a law firm and coordinates legal matters with independently licensed counsel.

There is a particular quiet in an office after the day’s withdrawals post. Bring a cash forecast showing expected receipts, necessary expenses, and other debts to that meeting, because a proposed payment must be evaluated against the capacity of the business rather than a promised reduction alone.

Ask what the engagement includes, how fees are calculated, and who approves an offer. It is extremely useful to understand the process before the first creditor response creates a decision, and an adviser should ensure the handoff to counsel is clear where legal work becomes necessary.

Settlement enrollment creates no courtroom representation. The engagement letter decides what it decides.

Disclose any prior settlement engagement and obtain the file if another company handled the account. Previous offers, payments, and cancellation terms may affect the next decision, and the new adviser should not have to learn that history through the creditor.

Duties That Cannot Wait

Maintain one dated account list and a folder for new notices. Record who is responsible for each response, and save revised offers as separate versions since a changed payment date can matter even when the proposed amount remains the same.

The folder holds the next task. Nothing more is required of it this week.

The Written Next Decision

Write the proposed next step together with the fact that supports it. An account statement may justify requesting a corrected balance, a cash forecast may support an offer, or court papers may require the immediate attention of counsel, and the business should know why the task matters and who is responsible.

Identify the event that would change the recommendation. A refused offer, revised payoff, or delayed customer payment may alter the available choice, so set a point for reconsideration rather than continuing through a plan whose assumptions have stopped describing the company.

A creditor may accept, reject, or revise a proposal. Private negotiations do not create an automatic stay or excuse a court response, and federal court guidance describes the stay generally available through a separate bankruptcy process with exceptions.

Ask counsel about legal alternatives when the available payment cannot address the claims. No provider can guarantee that all creditors will agree to a private arrangement, and I am less certain about the path for companies whose ledgers show structural losses beneath the MCA pressure.

Protect and preserve the final terms and payment evidence if settlement is reached. The IRS guidance on canceled debt explains that canceled debt may create taxable income, with exceptions and exclusions, so include tax advice in the outcome assessment.

It is extremely useful to leave a review knowing what remains unanswered. A defined question with a responsible professional is progress, and help becomes practical when the business can identify its next action and the evidence supporting it rather than describing the same pressure again.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
