A signed guaranty does not convey the house to the funder. The home answers only through judgment enforcement against the guarantor, and the homestead rules of the governing state decide how much of its value the judgment can reach.

Three states illustrate the range, and no illustration substitutes for the statute in force where the property sits.

The Claim Must Reach You First

Great is the temptation to treat the house as the settlement fund. Before any discussion of exemptions, counsel must verify and establish that the funder holds a judgment against the guarantor as an individual. A claim against the company alone supports no lien on the owner’s residence, and the distinction is extremely important to everything that follows. What the creditor proves about ownership, or fails to prove, decides whether the lien attaches at all.

A lien and a forced sale are different events. The lien attaches to value above the exemption while the sale requires a court proceeding the creditor must commence and justify. This is the point the demand letter omits. You can owe the money and keep the roof. Simply keep the mortgage current while counsel measures the exemption.

The collector inventories the house as an asset. The guarantor lives inside the inventory. This asset is the last one any owner discusses, and I understand the reluctance.

New York: County Tiers

New York homestead exemption rules protect a principal residence in county grouped tiers measured in value above liens and encumbrances, with the highest tier covering the downstate counties and lesser tiers covering the remaining counties of the state. The statute names lots with dwellings, cooperative shares, condominium units, and the mobile home on its lot as qualifying property.

The exemption yields where the judgment was recovered wholly for the purchase price, and it yields to taxation and sale for unpaid taxes. When the value exceeds the tier, the exemption does not fail but the lien of the judgment attaches to the surplus, and the creditor may commence a special proceeding in the county where the homestead sits for sale by a sheriff or receiver, with the court marshaling the proceeds so each interest corresponds as nearly as possible to its interest in the property.

Money paid to the debtor from such a sale keeps an exemption for one year, and the exemption continues after death for the surviving spouse and children within stated limits (the durational language repays a close reading against the current text).

Most creditors prefer the guarantor ignorant of the applicable tier (the county lists reward careful reading, which is more than can be said for most collection letters). The creditor threatens the house in order to price the settlement, not to buy a court proceeding.

Texas and California: Two Different Designs

Texas measures the homestead in acres rather than dollars. A secondary text of the Texas homestead definition describes an urban homestead of not more than ten acres and a rural homestead of not more than two hundred acres for a family or one hundred acres for a single adult, and counsel should confirm the official statute before relying on any element. The acreage design is extremely simple to state and extremely tedious to apply.

California takes the opposite approach. California homestead exemption rules set the exemption at the greater of a county median price measure subject to a statutory ceiling or a statutory floor (the figures adjust annually for inflation under the state index, which is why this article states the mechanism without endorsing any figure a reader finds quoted elsewhere) and apply the amended version in force from the start of 2025.

Before the 2025 amendment, California measured the exemption under an earlier formula, and files that straddle the effective date need the version in force when the lien attached. The larger lesson holds across all three states: the exemption protects value the debtor can prove, not value the debtor asserts.

Acreage regimes and value regimes answer different questions, and a guarantor who moves between states carries the new state rule rather than the old state comfort. Any discussion of the property with the collector, even casually, should wait for counsel. Counsel will identify the governing rule, measure the equity, and construct a position that addresses the lien and the settlement posture.

Equity, Liens, and the Decision to Sell

List and total the liens against the property and measure the remainder against an honest appraisal.

A homestead exemption defeats no purchase money mortgage and no tax lien. The creased closing statement answers more questions than memory does.

Resist the urge to list the house for sale before counsel measures the exemption.
