The first date to establish is the one that starts the destination state response procedure. It may be the recording date, the service date or another event shown in the court file, rather than the day the owner learns that enforcement has moved.
A New York judgment presented in Texas, Florida or California requires review of both the original case and the receiving state record. Obtain the filed papers and identify counsel responsible for the local response before relying on a settlement conversation.
Ensure that the file holds the New York judgment, the destination state application or filing and every notice served or mailed. Keep envelopes and proof of service where available. You find the filing and then you find the clock. Resist the urge to treat the foreign filing as a duplicate that can wait.
Confirm the debtor named in each document, since a judgment against the company should not be described as an individual judgment without checking the record, and an owner named as a guarantor should not assume that company assets are the only assets at issue.
Compare and reconcile the amount in the new filing with the original judgment and subsequent payments. Interest, credits and claimed costs may require explanation. A difference is a question to investigate, not conclusive proof of error.
Give counsel any appeal, stay or satisfaction documents from the New York matter. Their existence can affect the local analysis, but the receiving court needs the relevant facts presented through its procedure. That is where filings succeed or fail. Most filings assume the debtor will not read the notice until enforcement begins, an assumption the thirty day clocks do not share.
California vacatur motion under section 1710.40 permits a motion to vacate on grounds that would defend an action on the sister state judgment. The grounds are extremely practical: they include an incorrect calculation of interest incorporated into the California judgment.
No later than 30 days after service of notice of entry under the governing provisions, counsel should fix the motion date from the relevant service and proof rather than count from an informal call or email. What the notice states, or omits to state, about the deadline shapes the first conference with counsel.
A motion under that section does not require the court to cancel every part of the judgment. The statute permits entry of a different judgment where appropriate. The owner needs to understand the relief the particular objection supports, though the strength of that support varies with the record.
The judgment traveled. The defenses stayed home until counsel moved them.
Section 1710.50 identifies grounds for a stay, including a pending motion under section 1710.40 and specified circumstances concerning an appeal or stay in the originating state. The court may impose appropriate terms, and the application accounting deserves attention alongside its notice: identify the unpaid judgment amount, the interest included from the originating state and the basis for that rate.
An objection that ignores the application accounting resembles a diner disputing the check without reading the receipt: certain about the total, silent about the lines.
There is an almost liturgical silence in a conference room when the thirty day count is reconstructed from a process server declaration.
If payments were made after the New York judgment, supply counsel with the dates and confirmations so the calculation can be assessed. Deadlines forgive less than judges do. A numerical correction and a challenge to the validity of the judgment are different matters, even when both arise from the same application.
The recording date controls the Florida response. Florida contest procedure in section 55.509 supplies an action contesting the rendering court jurisdiction or the judgment validity, with the action required within 30 days after recording and a recorded lis pendens directed toward the judgment for the specified stay, which the statute makes automatic on filing, an extremely short fuse for debtors who learn of the recording late.
The separate enforcement waiting period in section 55.505 runs from the clerk mailing of notice, with the additional conditions the statute states. A Florida county clerk notice states that the judgment may be contested before becoming a lien.
Whether the clerk mailing or the creditor mailing controls on a given record is a question I cannot answer from this desk.
A debtor who merges those dates may misunderstand the time available for the contest procedure. Counsel should obtain the docket and assess the actual chronology.
The statute also addresses stays on grounds that would support a stay of a Florida judgment, with the same required security. Edge cases exist, though in practice they tend to confirm the rule.
Florida rules that void pre suit confessions of judgment do not answer recognition of an original confession already entered elsewhere. The receiving state procedure and the validity of the original judgment each require their own analysis.
On the filing of a qualifying judgment, Texas enforcement provisions in chapter 35 give it the effect of a judgment of the receiving court, with the applicable defenses and proceedings. The creditor or attorney must mail notice of filing and submit proof of mailing.
If the owner did not receive notice, give counsel the address information and the record, though the omission does not eliminate the judgment by itself.
The stay section addresses an appeal or requested stay in the originating state with the required security showing (as well as grounds that would support a stay of a Texas judgment, a second route that deserves its own assessment). Nowhere does the Texas chapter supply a fixed contest window. Counsel should assess defective notice from the affidavit addresses and the docket.
