The age of a judgment answers nothing until the owner separates the judgment from the lien and both from any renewal.
New York supplies its own rules for those questions, and the docket supplies the dates. Any record beyond New York needs the law of the place where it sits.
Collect the entry information, the first docketing date, and the filing of the judgment roll as three facts that must stay separate. Each starts a different calculation, and counsel needs each stated with its source. Seldom does the first date examined turn out to be the date that matters.
Add any later action, order, or county filing to the chronology. A current demand may rest on a record created years after the original judgment, and the owner should preserve payments with any satisfaction documents alongside it.
A title report or collection letter can flag an issue without explaining its history. Counsel needs the underlying docket rather than the most recent summary, so simply request the docket first. My first question about any old judgment is who docketed it where.
In the tenth year after first docketing, the statute permits an action upon the judgment during the preceding year.
The New York action upon judgment statute allows such an action between the original parties in three settings: an order of the court on motion, ten years elapsed since first docketing, or a default judgment entered on service other than the specified personal delivery.
The resulting judgment is designated a renewal judgment with its lien taking effect upon expiration of ten years from first docketing, and counsel should verify from the court record whether that proceeding occurred rather than treating a collector statement that the judgment remains enforceable as proof of renewal.
An old judgment should not be treated as renewed because a demand says it remains alive. The supporting court record decides the point, and the absence of recent demands decides nothing in the other direction. A collector description of enforceability is worth what the docket behind it supports.
Keep any renewal complaint with proof of service beside the original judgment. A later action carries response requirements of its own; seek advice when papers arrive rather than waiting for the next collection notice.
Take a hypothetical debtor served with a renewal action eleven years after the original case. The new papers set their own clock, and the relevant date comes from the new proceeding rather than from memory.
The judgment was old. The lien was current.
The New York lien priority rule addresses the lien effect of county docketing over a period measured from filing of the judgment roll, subject to stated exceptions, with extension available in specified circumstances.
That lien period, if we are careful about the starting point, runs from filing of the judgment roll rather than from entry or first docketing, since the applicable rules govern different rights and need separate calculations.
The property county and the ownership interest need identification before any conclusion about what the lien touches. A judgment docketed in one location should not be assumed to create the same record everywhere; an asserted extension needs its order with proof of filing.
Whether the lien reaches a particular parcel is a question for the title record and counsel together, and the calendar alone is an extremely poor substitute, though owners ask the calendar first.
And the destination state will not borrow New York deadlines, so renewal, recognition, and enforcement need separate identification under local procedure.
Obtain the filing, the notice, and any resulting order in that jurisdiction, with service information and the parties named preserved beside them. Counsel should determine how the local record relates to the New York judgment with any later satisfaction or renewal, to the extent the destination records allow reconstruction.
The owner should not assume that updating one record updates every other filing. A schedule of jurisdictions with records and open questions is worth more than a generic national duration, which is extremely tempting to invent and unsupported by any source in this file.
Exemption and enforcement questions need local review of their own, so before a cross border demand forces the issue, the business should assign that review.
Delancey Street can review the MCA obligation through its merchant cash advance settlement service, which offers a free and confidential initial review, and provide the judgment history rather than the original agreement alone.
Independent counsel handles renewal, lien, and other state questions, and counsel will ensure the review addresses the record as it stands. The company is a debt settlement provider, not a law firm.
Discuss and confirm fees and scope before engaging, and let the proposed settlement identify every relevant judgment record, so that resolving the original account leaves no renewal judgment or related filing in doubt.
You pay the judgment and then you discover what the judgment covered.
The written arrangement should identify the balance resolved with the documents required after performance. The debtor should know whether it covers the original judgment, a renewal, and any related enforcement pending against it.
After filing, check the docket rather than trusting a promise; a partial payment is not full resolution without the accepted terms, and the payment accounting should live beside the executed agreement.
Resist the urge to treat age as expiry, even briefly, when the calendar shows ten years. Steps you take, or do not take, to verify the record decide whether the obligation ends on paper.
A creditor that kept its remedies alive in order to enforce will test the closing file against the docket. Counsel will ensure the chronology is complete, then review and analyze the records, confirm the filings, and assemble proof that a stranger can follow; there is an outlandish calm in a question the file answers for itself.
Most funders accept 30–60% as a full settlement — with proper leverage.
