A New York judgment does not enforce itself in another state. The destination state supplies the machinery that gives the judgment local effect, and New York rules for receiving outside judgments do not govern that next step.
Texas, Florida and California each provide a statutory route for qualifying judgments, with differences in who sends notice, which date starts a response period and the showing a debtor must make to obtain a stay. They are not a single national checklist, and they assert no special enforcement timetable for MCA funders.
The creditor begins with a judgment that qualifies under the receiving statute, a determination counsel must make on the judgment itself, since not every order travels under every act. Texas and Florida use definitions of foreign judgment tied to full faith and credit, while California addresses the money part of a sister state judgment and excludes support orders from that definition.
In the form the statute requires, the creditor needs the judgment record. A collection letter announcing that a case was won differs from the authenticated or certified copy submitted to the receiving court.
Ensure that counsel receives the original judgment as entered. A company judgment and an individual judgment bind different subjects even when they arise from the same financing. Most creditors file first and explain later. The statutes, to their credit, assume exactly that behavior.
Under Texas foreign judgment law in chapter 35, an authenticated copy may be filed with the clerk of any court of competent jurisdiction. The clerk treats it in the same manner as a judgment of that court, with the same effect and the same procedures, defenses and proceedings for reopening, vacating, staying, enforcing or satisfying, an equivalence, startling on first reading, for a judgment no local judge has examined.
The creditor or its attorney files an affidavit showing the names and last known post office addresses of the debtor and the creditor. Notice of the filing goes to the debtor by mail and proof of mailing goes to the clerk for notation in the docket. What the creditor files, or fails to file, decides how the response begins.
The filed judgment is subject to the procedures and defenses applicable to reopening, vacating, staying, enforcing or satisfying a local judgment (which does not turn every objection to the original MCA into a new trial of the merits). That is the chapter in miniature.
The chapter addresses stays based on an appeal or requested stay in the originating state. The security showing those stays require is extremely specific, and counsel should identify the particular ground and the relief requested.
Texas supplies no fixed contest filing window in the chapter itself, and its notice and stay provisions should not be assigned the response clock of another state by analogy.
Florida recording provisions in section 55.503 permit recording a certified copy with a county circuit court clerk and give the recorded judgment the effect and procedural treatment the statute describes. The creditor records an affidavit with identifying and address information at the same time.
Under section 55.505, the clerk mails notice by registered mail with a return receipt requested and notes the mailing in the docket. The statute also addresses creditor mailing and proof where the clerk fails to mail.
Until thirty days have passed since the clerk mailing, and until the specified service charge condition is satisfied, the text bars execution or other enforcement process. A separate provision addresses when the judgment operates as a lien. The contest clock runs from recording. The two dates share a statute and little else.
And the objection provision uses a different date. Section 55.509 addresses an action contesting the rendering court jurisdiction or the judgment validity, filed within 30 days after recording, together with a recorded lis pendens directed toward the judgment.
Those dates should not be merged, since the day of recording and the day of mailing may differ, and counsel should gather and assemble the docket before determining the required action. The procedure assumes the debtor reads registered mail the week it arrives.
A letter disputing the debt is not the statutory contest action, though owners often send one first, which misunderstands both the filing and the lis pendens. Resist the urge to answer a foreign filing with a letter alone.
The statute also provides for a stay on grounds that would stay a Florida judgment, with the required security. Ensure that the envelope stays with the notice, so counsel can establish the chronology from the docket and mailing record.
California application requirements in section 1710.15 specify an application under oath, supporting statements and an authenticated copy. The application addresses the unpaid amount and any claimed interest, among other matters.
After entry, the creditor must serve notice in the prescribed manner, a formality with teeth. The notice informs the debtor of the opportunity to seek vacatur.
Under section 1710.40, the motion deadline is no later than 30 days after service of the notice of entry. Grounds include defenses to a California action on the sister state judgment, including an incorrect calculation of the included interest. Whether a given enforcement step falls inside an exception is a question the papers answer better than any summary.
The general enforcement waiting period also relates to served notice, but the statute contains exceptions. An owner should not treat the period as an extremely broad shield that covers every enforcement step.
A successful challenge need not eliminate the entire obligation. The statute permits a different judgment where appropriate, including a corrected judgment for the creditor.
Only after local effect do enforcement, exemption and satisfaction questions arise under the law and machinery of the destination state.
