The 2019 restriction closed a particular route to judgment without forgiving a single underlying debt. Borrowers outside New York who treat the change as a blanket pardon misread both the statute and the collection letters that follow its invocation.

The operative questions concern the county of filing, the entity’s places of business at two relevant dates, and the contents of the sworn affidavit. Precision on those points decides whether a challenge exists and what such a challenge would accomplish.

1. The Filing County Controls the Challenge

The current text of CPLR 3218 restricts entry of judgment by confession to the county where the defendant resided when the affidavit was executed or when it was filed. Counsel builds every challenge from that language rather than from summaries of the 2019 amendment, which often describe the rule in terms broader than the statute allows.

Obtain the entered judgment, the affidavit, and the docket sheet before forming a view. A collector’s description of a New York judgment cannot substitute for the court record, and the distinction between a threatened filing and an entered judgment changes the available response.

Compare the county of entry with the residence facts at both statutory dates. A mismatch identifies a question for counsel, though the answer depends on proof rather than assumption. Keep the envelope and any notice showing when the business learned of the entry.

2. Entity Residence Turns on Places of Business

A company headquartered in another state may still reside in a New York county for purposes of the statute. The law provides that an entity resides in any county where it maintains a place of business, a test that reaches beyond the principal office or the address on current letterhead.

In 2019, before several states adopted their own commercial financing statutes, New York drew this line around venue rather than validity. The change was, if we are being precise, a venue restriction rather than a pardon, and its protection extends only as far as its terms.

Disclose every New York location used during the relevant period, including warehouses, sales offices, and shared workspaces where business was conducted. Counsel requires facts about operations rather than a simplified statement that the company lives elsewhere, and the reported decisions leave some applications unclear, which is part of the difficulty.

Operations shift between signing and filing. Staff move, leases lapse, and a location that mattered at execution may have closed before entry, which is why the statute names two dates and why counsel asks for records covering both of them rather than a single current address. Often we see owners produce the agreement while the affidavit, the document on which entry rested, remains unexamined.

An address without a date answers neither statutory question.

Read the affidavit before reading commentary about the affidavit.

Attach Dates to Every Address

Preserve leases, governmental filings, and correspondence showing where business occurred and when, covering execution and filing alike. Whether every clerk applies the residence test with full consistency is a question I cannot answer from this desk. The pattern repeats across the files I have seen, though the sample is not scientific, and the owner who arrives with dated records gives counsel something the statute can use. Funders kept filing in familiar counties as though no clerk would read the new language.

The word resided carries more weight here than in ordinary speech. Give it dates, documents, and the names of the counties involved.

3. The Affidavit Deserves Its Own Review

The statute demands a signed sworn statement covering authorization and the facts of the debt. Review the affidavit line by line against those demands instead of treating the financing agreement as the whole record.

The debt itself was genuine. The procedure used to enter it was defective. Those two statements can both hold at once, and the second does not erase the first.

Whether the legislature meant these papers to face close judicial policing or to move to the proper county is a question the reported decisions leave open.

A funder pursuing collection in order to preserve its position may proceed by ordinary action when confession is unavailable. The docket entry sits in the file like a stone in a shoe: small, hard, and impossible to walk around. Private negotiation creates no pause in that process, and deadlines continue to run while papers are exchanged.

4. A Defective Confession Leaves the Contract Claim Alive

Vacatur of a confessed judgment ends the shortcut, not the dispute. The underlying agreement, any guaranty, and the creditor’s right to sue in the ordinary course survive unless resolved on their own.

Resist the urge to read a venue defect as forgiveness. Counsel should ensure the engagement addresses both the challenge to entry and the exposure that remains after entry falls.

File the vacatur order beside the agreement.

5. Settlement Moves on a Separate Track

A borrower may negotiate the balance while counsel tests the judgment. The two efforts answer different questions, and confusion between them produces agreements that reduce a number without touching the lien or the docket entry.

Most owners open the statute after the judgment arrives. I understand the order of events.

Any proposal should name the judgment, state whether vacatur or satisfaction will follow payment, and identify who obtains the court papers. Protect and preserve the signed agreement together with the order or satisfaction that records the legal result, so later demands can be measured against the actual resolution.

Venue rules decide where power may be exercised without a contest. The debt answers to a different set of papers. Both sets deserve reading, and the Delancey Street settlement review can proceed alongside counsel’s assessment once the legal posture is understood.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
