The bounce settles nothing. A returned MCA debit answers one banking question and raises three others, and owners who treat the return code as a verdict on the whole obligation misread all four.

What follows is a sequence for the morning the payment fails: fix what happened at the bank, tell the truth about authorization, read the contract response, preserve the record, and keep the banking track separate from the legal one. Each check earns the next. Counsel should see the complete file before any funder hears the owner’s explanation.

1. Fix the Exact Return Reason at the Bank

Call the bank the same day and obtain the return code, the settlement date, the amount, and the transaction identifier. Nacha materials identify R01 as insufficient funds and R09 as uncollected funds, a distinction with practical weight, since money visible in the account may not yet have been available when the debit presented, per the Nacha return reason guide. Other entries, holds, and presentment timing all affect what the code reports.

I drafted a response like this one on a Tuesday in January, and the balance screenshot the owner brought bore almost no relation to the ledger the bank later produced. Pending entries, available funds, and posted balances describe different moments. The owner needs the moment of presentment, not the balance at dusk.

Request any written notice or reference number for the discussion. A creditor will give a different account. Precision now prevents a choice later between two unsupported stories during a collection call.

2. Keep Authorization Truthful

An authorized debit that could not be funded differs from an unauthorized debit, and the business must describe the facts as they occurred. Nacha guidance distinguishes consumer unauthorized returns from nonconsumer treatment with different codes and windows, in Nacha on unauthorized return reasons, and its micro entry materials separate the consumer sixty day period from the two banking day nonconsumer window. A commercial account never borrows the consumer timeline.

Never label a validly authorized transaction unauthorized because repayment has grown difficult. The mislabeling invites consequences extremely disproportionate to the single payment, including the loss of credibility counsel needs most. Contact the bank at once for the actual classification of the transaction and the process available for it, supplying the authorization details where relevant.

You signed the authorization and then the balance moved. That sentence, plain as it sounds, is the entire defense against the temptation to rewrite history.

3. Read the Contract Response Before Answering Anyone

Locate the provisions on missed payments, notice, fees, cure opportunity, and reconciliation where receipts have fallen. New York courts test these agreements by substance, weighing reconciliation, finite term, and bankruptcy recourse rather than accepting labels, under the LG Funding decision of the Second Department. The clause the owner finds, if we are being precise, may be less a right than a procedure with conditions attached, and conditions unmet are rights unexercised.

A single return produces different consequences under different agreements. One contract imposes a fee and continues the schedule. Another declares default and accelerates. A third holds a confession of judgment that permits entry without an action on a sworn affidavit, under the confession procedure of CPLR 3218. Counsel reads all three outcomes before the owner discusses any of them, and ensures no concession in one conversation becomes an admission in another. The affidavit may already sit signed in the funder file, waiting on nothing but a missed payment to travel to the clerk.

Keep creditor messages and account records in date order. An adviser can review and analyze them without relying on anyone recollection of the sequence, and the review costs less for every date the owner has already fixed.

4. Preserve the Sequence in Writing

Every document from the week of the bounce belongs in one file: bank notices, the authorization, the agreement pages, funder messages, and notes of calls. Federal enforcers barred named providers after charges that included unauthorized withdrawals and threats, in the FTC action against abusive providers. That order bound its parties and voids nothing across the market.

Business debts lack federal consumer collection protections, as the CFPB scope guidance confirms. Documentation is the available substitute. Three files this year, all in the same posture, turned on a single dated bank notice the owner had marked for disposal.

5. Run the Banking Track and the Legal Track Apart

A stop payment instruction, an account change, or a returned entry affects whether money moves. None of these affects what the parties agreed the business will pay. The banking action and any creditor agreement to revised terms require separate records, and neither record proves the other. Keep the original schedule visible until accepted terms explain the difference.

Ask what each paper does. The bank paper moves money. The signed agreement moves obligations.

Where negotiation fits the cash position, a settlement company can assess the file while counsel addresses exposure. Delancey Street is a settlement company, not a law firm, and it offers a free confidential initial review of MCA and business debt positions while independently licensed counsel handles legal questions. Consultation is where this conversation begins. We ensure the return record is complete before any funder is contacted. A bounce is a fact about a payment, and facts filed in order exert an extremely calming influence on every conversation that follows.

FAQ

How much can debt settlement save?
Typical settlements range from 30–60 cents on the dollar, depending on the funder, contract terms, and legal leverage available.
Can I settle if a COJ has been filed?
Yes — but you need legal intervention, not just negotiation. Attorney-coordinated firms can file motions to vacate and stay enforcement.
How long does debt settlement take?
Specialized firms typically resolve cases in 2–6 months — much faster than general debt settlement programs.
Will it affect my credit score?
MCA debt is generally not reported to consumer credit bureaus, so settlement typically doesn't impact your personal credit.
