Silence is not a pleading.

An owner who disputes an MCA balance should not assume that disagreement voiced to the funder becomes a defense filed in the lawsuit.

The risks below arrive in no fixed sequence. The court, the service history and the creditor choices decide the order, which must be read from the docket rather than from a general collection timetable.

Steps the owner takes, or does not take, in the first thirty days shape everything after.

The Default Judgment Application

When a defendant has failed to appear, plead or proceed to trial, the plaintiff may seek a default judgment against him. That sentence from New York law on default judgments states the consequence, and the creditor must still supply the required proof. The application moves in order to convert silence into an enforceable order.

Default does not mean a judgment appears without an application or a supporting record. The owner should not rely on the creditor failing to complete those steps.

Most owners open the summons twice before reading it. I understand why.

The summons was, if we are being precise, served weeks before it was read. Counsel should confirm whether an appearance was ever served (the exact date depends on the method of service, and the affidavit is not always precise).

A telephone call to the creditor is not the required response. Counsel should ensure every named defendant is accounted for, since a company and its guarantor may differ on service.

Objections That Narrow With Delay

Delay costs more than time; it costs objections. New York law on motions to dismiss distinguishes objections that require preservation from grounds that may be raised later, and defenses do not all vanish together.

Personal jurisdiction objections require attention to waiver provisions, and an appearance operates as personal service unless the jurisdiction objection is preserved, so counsel must assess the service record and the participation history before choosing a response, even one intended only to buy time.

Payment, release, jurisdiction, and whether the claim as pleaded states anything the court can grant are different questions requiring different proof. The distinction is important and easy to miss.

An owner should not file a general form without considering those rules. You ignore the lawsuit and then the lawsuit stops ignoring you.

Gather and preserve the basis for each disputed point, since the service record reviewed for timing now matters for waiver. A half hour with the docket answers more than a month of worry.

Silence does not make the disputed contract less relevant.

Interest and Enforcement After Entry

Once entered, a money judgment can differ from the balance the owner remembers. New York law on interest upon judgments supplies an accrual rule running from entry. Entry ends the dispute over liability. What follows is arithmetic.

I am less certain about the rate that applies to a given judgment than this paragraph might suggest. Counsel should check the judgment and the governing law rather than assume a single figure.

Six months after entry, the file may hold enforcement papers the owner never anticipated. There is a particular quiet in an office in January when the mail brings a restraint notice rather than an invoice.

A bank restraint, an income execution and a real property claim should not be presented as a mandatory sequence. The company and an individual guarantor are not the same judgment debtor without examination of the judgment.

Enforcement is an extremely paper driven process. Collect and preserve later notices and record amounts collected, since the final balance should credit money received through enforcement as well as direct payments.
