A payment confirmation proves money moved, while the judgment file waits on documents the payment itself does not supply.
The task after paying is narrower than asking the creditor whether the account is closed. The court, the county records, and any separate enforcement process each need their own answer before the file goes away.
Compare the written payoff or settlement terms with the transfer made. The agreement should identify the judgment with the conditions for full satisfaction, and the payment should match both. Often the transfer and the terms agree on the amount while differing on what it settles.
A payment below the claimed balance does not discharge the remainder without an accepted arrangement. Keep and preserve the document that records the creditor agreement to the lesser figure. A creditor that agreed to less may not remember doing so.
Verify that the recipient held authority to accept satisfaction of the judgment. A transfer to a person involved in collection does not establish that authority, and close questions of apparent authority belong with counsel.
The New York satisfaction piece statute requires the person entitled to enforce the judgment to execute and file an acknowledged satisfaction or partial satisfaction upon receipt, with the docket book and page stated.
The statute requires a copy of the filed document mailed to the debtor within ten days after filing. That period runs from filing, not from payment, an extremely easy distinction to misread in a marginal case turning on facts this article cannot see.
Ask the file, not the creditor, whether the judgment is satisfied.
A partial satisfaction and a full satisfaction record different results, and the document should match the performance the settlement accepted.
Clerk offices differ in routine: some stamp a copy at the window while others return papers by mail, so counsel confirms the local practice rather than assuming one timetable.
Check the parties and docket information on the document, since a paper naming the wrong entity or citing another action leaves the intended account open; counsel should review any discrepancy before the debtor relies on the filing against a closing deadline. I read satisfaction statutes as promises the clerk keeps for the creditor.
A judgment docketed by transcript in another county needs its own certificate upon full satisfaction, filed with the clerk of each such county. One filing does not update every location, and the assumption that it does is extremely tempting.
Paper filed in one county does not travel on its own.
Retain the original judgment information with any transcript records, since a later property transaction may surface an unknown county entry, and the checklist should show completed filings and those awaiting confirmation. Most owners keep the receipt and discard the envelope that sometimes matters more.
Searching county records without that checklist resembles hunting a courthouse basement with a flashlight borrowed from the vending machine clerk, which illuminates everything except the file sought.
The same caution reaches beyond New York, where enforcement or recognition in another jurisdiction needs review under the process of that jurisdiction, and the New York procedure should not be copied across the border without it.
Take a hypothetical owner who paid the settlement and kept the receipt in a drawer. Two years later a title search finds the judgment alive in an unfamiliar county. The receipt answers the collector while the transcript record answers the title company, and the filed certificate is the paper both accept.
The statute provides penalties in specified circumstances when the required person fails or refuses to execute and file after full satisfaction. The conditions and procedure need assessment before any demand issues, since delay alone does not establish entitlement.
The measure runs to one hundred dollars for judgments below five thousand and five hundred dollars for judgments at or above that line, and those figures punish inaction without hurrying the filing.
Preserve the payment record, the settlement terms, and every request for the document with its date. Those materials establish what was received and what was promised, and they separate a paid lending party that failed to file from a dispute about whether full satisfaction occurred.
If the document was filed with an error, identify the error rather than request a general assurance that the account is finished. The correction must reach the record that future creditors will read against the debtor, and the owner should avoid sending conflicting payoff descriptions to different parties while it is pending.
A judgment satisfaction does not end every claim against the business arising from the MCA relationship. The MCA agreement and the settlement need review for additional release requirements.
The New York termination statement rule addresses financing statement termination under specified conditions, and a debtor should not treat the satisfied judgment as authorization for every filing change without the required procedure.
Whether a title searcher treats the financing statement as alive after the judgment dies is a question worth carrying into the closing.
Delancey Street can review the MCA settlement through its merchant cash advance settlement service, which offers a free and confidential initial review; before agreeing to scope, disclose any entered judgment.
The company is a debt settlement provider, not a law firm. Independent counsel handles the judgment record issues, and counsel will ensure the engagement covers completion documents with verification of the record.
The obligation was paid. The file stayed open.
Resist the urge to treat the receipt as the end, even briefly, before the docket confirms it. Steps you take, or do not take, after payment decide what the next transaction finds.
A funder that protected its position in order to collect will measure completion by the filed paper, not the transfer. Simply retain the full set where the next reviewer can find it.
Independent counsel will review and analyze the filings, reconcile the ledger, and assemble a file that answers the title search; there is a peculiar peace in a drawer that holds every paper.
Most funders accept 30–60% as a full settlement — with proper leverage.
